Man accused of vehicle theft acquitted by Cannock Magistrates’ in his absence

 

A man accused of taking a motor home in the Featherstone area represented by Stephen Lee stood trial at Cannock Magistrates Court in November 2016.

He was accused of travelling to the local area from Essex specifically targeting motor home vehicles. The client, represented by Stephen at trial, maintained his innocence throughout the proceedings and despite being unable to attend his trial was acquitted in his absence on a half time submission of no case to answer*.

Despite police officers attending to give evidence against him Stephen Lee successfully persuaded the bench of Magistrates that the prosecution could not prove their case beyond reasonable doubt due to evedential issues with identification and the lack of forensic evidence.

The client was absolutely delighted with the outcome and praised the skill and tenacity of his advocate that helped him achieve the finding of not guilty.

 

*A ‘no case to answer’ submission is a legal argument put to the Court at the conclusion of the prosecution’s case. The submission cannot be used in every case because it is reliant on the strength of the prosecution’s evidence, or rather the lack of it.
