Emergency drink driver keeps licence


A Lichfield woman who drove in an emergency while nearly 3 times over the legal limit has kept her driving licence after Magistrates found special reasons not to disqualify.

Special Reasons

The woman who pleaded guilty to an offence of drink driving while nearly three times over the legal limit was today told by Cannock Magistrates that she could continue driving after a contested special reasons hearing.

She told magistrates that she drove due to an emergency arising.

Contested Hearing

Stephen Lee, who conducted the hearing, was able to persuade the Magistrates that the emergency was genuine despite a strenuous fight by the Crown Prosecutor who maintained throughout that she was not telling the truth.

Absolute Discharge

As a result she received an absolute discharge for the offence and 6 points on her driving licence.

Following the hearing, the client, who was obviously relieved and delighted with the outcome, stated she was very glad she had instructed Sheppards Solicitors to undertake this work for her and stated that the representation she received was honest and straightforward from the start.

Rare Outcome

It is rare for the Magistrates to make such findings in drink driving cases and such cases need careful preparation.
