Driving licence saved for driver following ‘special reasons’ argument

Ian Hodnett successfully argued special reasons not to disqualify a driver who had been accused of drink driving. The client had been accused of driving with excess alcohol having been required to move a vehicle a short distance to avoid a disturbance in the street.

Mr Hodnett argued that given the circumstances and shortness of distance driven, it would have been wrong to impose the normal obligatory disqualification. The magistrates agreed with the submissions and the client was able to retain his driving licence, crucial for his ability to be able to work.
