Those who receive benefits from the State are all too familiar with the scrutiny sometimes afforded to them by Local Authorities. Historically investigations commenced by way of tip off rather than a structured investigative approach. However, more recently the DWP (Department for Work & Pensions) have become more pro-active and now have full time investigators and a legal department who are part of the Crown Prosecution Service. The investigators have more surveillance tools available to them than ever before and as a result there has been an increase in benefit fraud prosecutions.
Those under investigation for benefit fraud are often experiencing their first exposure of the Criminal Justice System and this can cause a great deal of stress to the individual and their families.
Our benefit fraud solicitors are highly experienced in understanding the particular problems each case may represent and our solicitors are there to provide quality legal advice, and reassurance, through every stage of any investigation.
Usually, the first an individual will know they face investigation is when they receive a request to attend at the Local Authority for an interview under caution. If you have been “invited” for an interview it is vital that you are represented by an experienced solicitor who will be able to advise you prior to the interview what the investigation relates to.
During the interview questions will be asked about your initial claim and any changes that may have occurred since the initial claim. Evidence that the DWP or Local Authority believe support their argument will be put to you. This evidence may include employee details, account details (bank statements), surveillance footage or witness statements.
The types of benefit fraud investigated are:-
- Income Support (IS)
- Job Seekers Allowance (JSA)
- Employment & Support Allowance (ESA)
- Disability Living Allowance (DLA) – care and mobility components
- Incapacity Benefit (IB)
- Housing Benefit (HB)
- Council Tax Benefit (CTB)
Sheppards Solicitors have successfully represented many clients accused of benefit fraud.
